1. Acceptance
By creating an account on scxale.com or using any part of the service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
These terms are between you ("you", "customer") and scxale ("scxale", "we", "us"), a software-as-a-service operated from the Netherlands.
2. The service
scxale is a suite of tools for Shopify founders: keyword research, AI-generated product descriptions, invoice and COGS matching, notification routing, ROAS and profit tracking, and related features. The exact feature set evolves over time. We may add, change, or remove features at our discretion, and will communicate material changes by email.
3. Account and eligibility
You must be at least 18 years old and legally able to enter into a contract. You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately at info@scxale.com if you suspect unauthorized access.
4. Subscription and billing
scxale is a paid subscription at $49/month. New accounts get a 30-day free trial, which requires a valid payment method up front. Your card will be charged automatically at the end of the trial unless you cancel first.
- Subscriptions renew monthly on the same calendar day you signed up. Payment is processed by Stripe.
- If a payment fails, we grant a 7-day grace period during which the service remains available. After that, access is suspended until the balance is paid.
- All prices are in USD. Taxes (e.g. VAT) may be added at checkout depending on your location.
5. Cancellation and refunds
You can cancel your subscription at any time through the billing portal linked from your settings page. Cancellation takes effect at the end of the current billing period — you keep access until then.
We do not offer pro-rated refunds for partial months. If you cancel during the 30-day trial, you are not charged. If you believe you were charged in error, email info@scxale.com within 14 days of the charge and we will review in good faith.
6. Acceptable use
You agree not to:
- Use scxale to break any law or any platform's terms of service (Shopify, Google, Meta, TikTok, Discord, Stripe, OpenAI).
- Reverse-engineer, scrape, or attempt to extract source code from the service.
- Resell, sublicense, or white-label the service without written permission.
- Use the service to send spam, phishing messages, or unsolicited bulk email.
- Upload malware, attempt to gain unauthorized access to our systems, or interfere with other customers' use of the service.
- Use AI description features to generate knowingly false or misleading product claims.
We may suspend or terminate accounts that violate these rules, with or without notice.
7. Your data and connected accounts
You retain full ownership of all data you connect to or upload into scxale — product catalogs, orders, invoices, COGS sheets, ad performance, and everything else. By using the service you grant us a non-exclusive, limited license to process that data solely in order to provide the features you have enabled.
You are responsible for ensuring you have the right to connect any third-party account (Shopify store, Google Ads account, etc.) and to use any data you upload. You are also responsible for complying with those third parties' own terms of service and rate limits.
8. Intellectual property
The scxale name, logo, software, and documentation are our property. These terms grant you a limited, non-transferable, non-exclusive right to use the service during your active subscription — nothing else.
9. Availability and support
We aim for high availability but do not offer a formal SLA. Scheduled maintenance, third-party outages (Shopify, Google, Stripe, Supabase, Vercel), and force-majeure events may temporarily affect the service.
Support is provided via email at info@scxale.com and via our Discord community. We aim to respond to billing and account issues within 2 business days.
10. Disclaimer of warranties
The service is provided "as is" and "as available". To the fullest extent permitted by law, scxale disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that calculated metrics (ROAS, COGS, profit) will be accurate in all cases — you are responsible for verifying figures before making business decisions.
11. Limitation of liability
To the maximum extent permitted by law, scxale will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of or relating to your use of the service.
Our total cumulative liability for any claim relating to the service is capped at the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify and hold scxale harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these terms, your misuse of the service, or your infringement of any third party's rights.
13. Termination
You can stop using the service at any time by cancelling your subscription and optionally deleting your account. We can terminate or suspend your access immediately if you violate these terms, with or without notice. On termination, the license to use the service ends, and we will delete your data per the schedule in our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time. When we do, we will update the "last updated" date above and, for material changes, notify active customers by email at least 30 days before the changes take effect. Continued use of the service after that period constitutes acceptance of the new terms.
15. Governing law
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the service will be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands — except where mandatory consumer-protection law in your country of residence grants you the right to sue locally.
